1. Acceptance of Terms
By accessing or using the Jesse platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Jesse is a multi-tenant SaaS platform that provides AI-powered chatbot services tailored for restaurants. Our service includes AI chatbot responses, menu knowledge management, conversation analytics, multilingual support, and website widget integration.
3. Account Registration
To use our Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Service.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Upload misleading, false, or harmful menu information
- Attempt to reverse-engineer, decompile, or disassemble the AI models
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to send spam or unsolicited messages
- Impersonate another person or entity
- Share your account credentials with unauthorized third parties
5. Subscription & Payment
Our Service offers subscription-based pricing plans. Payments are processed securely through Paddle, our merchant of record. By subscribing, you agree to Paddle's terms of service in addition to these Terms.
- Subscriptions auto-renew unless cancelled before the renewal date
- Prices may change with 30 days' prior notice
- Paddle handles all payment processing, tax calculation, and invoicing
- Refunds are subject to our Refund Policy
- A free trial period may be offered to new accounts. Trial terms, duration, and eligibility are outlined in our Refund Policy.
6. Intellectual Property
The Service, including its design, AI models, algorithms, code, and documentation, is owned by Jesse and protected by intellectual property laws. You retain ownership of your content (menu data, custom knowledge, branding) that you upload to the platform.
You grant us a limited license to use your content solely for the purpose of providing and improving the Service.
7. User Content
You are solely responsible for the content you upload to the platform, including menu data, images, FAQs, and chatbot configurations. You represent that you have the right to use and share all content you upload.
We reserve the right to remove content that violates these Terms or is otherwise objectionable.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated responses may occasionally be inaccurate. We do not guarantee uninterrupted or error-free availability of the Service. We are not liable for any loss or inconvenience resulting from service downtime, maintenance, or outages.
9. Limitation of Liability
To the maximum extent permitted by law, Jesse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising from your use of the Service.
Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
10. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time through the platform settings.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia as the primary governing jurisdiction.
Notwithstanding the above, we recognize applicable mandatory consumer protection and local laws in the jurisdictions where our users are located:
- Australia: Users in Australia have rights under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth), which cannot be excluded by these Terms.
- Singapore: Users in Singapore are subject to the Consumer Protection (Fair Trading) Act 2003 (CPFTA) and relevant regulations under the Info-communications Media Development Authority (IMDA).
- Malaysia: Users in Malaysia have rights under the Consumer Protection Act 1999 and the Communications and Multimedia Act 1998.
- European Union / United Kingdom: Users in the EU or UK retain rights under applicable EU consumer protection directives and UK Consumer Rights Act 2015.
- Other Jurisdictions: We will make reasonable efforts to respect mandatory consumer rights laws applicable in your jurisdiction.
For disputes that cannot be resolved informally, we will make good faith efforts to resolve the matter through negotiation before initiating formal legal proceedings. Contact us at founder@jesseapp.com to initiate a dispute resolution process.
12. AI-Generated Content Disclaimer
Jesse uses multiple AI providers to generate chatbot responses on behalf of restaurant operators. Please note:
- AI-generated responses are automated and may occasionally be inaccurate, incomplete, or outdated.
- Restaurant operators are solely responsible for ensuring the accuracy of information provided in their knowledge base, including menu items, pricing, allergen information, and operating hours.
- Jesse is not liable for any loss, harm, or adverse reaction experienced by end customers based on AI-generated chatbot responses.
- For safety-critical information, particularly allergen and dietary queries, Jesse's AI is configured to recommend that customers confirm directly with restaurant staff. However, this does not constitute a guarantee of accuracy.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
